Terms of Service

1. Acceptance of Terms

By accessing or using Generative Cats (“the Service”), a product of Confirm Concept LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance of the revised terms.

2. What the Service Is

Generative Cats is a shared generative cosmos. Members describe a material; an AI model generates a cat card from that description. Cards can be created from scratch (originals), varied from one existing card (remixes), or blended from two (merges). Everything made here lands in one shared space organized into galaxies, stars, and planets. Nothing you make is private to you, and nothing you make is exclusively yours — see sections 7 and 8.

3. Accounts and Anonymity

You sign in with Google. We do not create or store passwords, and we receive only your email address — not your name and not your Google profile photo. Your public identity is a star name that the platform generates from what you create; you do not choose it and it is not your real name.

Everyone on the platform is anonymous to everyone else. Generated content carries no attribution to an individual person anywhere except at the account level. You may hold one account. You are responsible for the security of the Google account you sign in with.

4. Minimum Age

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. We do not knowingly collect information from children under 13; if you believe a child under 13 has an account, write to privacy@generativecats.app and we will delete it.

5. AI-Generated Content

Cat images and the platform's other artwork are generated with OpenAI's gpt-image-2 model. Google's Gemini 3.1 image models on Vertex AI stand by as a fallback and may serve your generation if the primary provider is unavailable. Text — names, traits, lore, and bios — is generated with Gemini 2.5 Flash on Vertex AI. We may change models or providers as the technology moves; the Privacy Policy always names the current ones.

• Generation is unpredictable. Output may not match what you had in mind, and we do not guarantee it will.
• Output is not guaranteed to be unique across all AI platforms, only within this one.
• AI models carry imperfections and biases. We do not warrant that output is free of them.
• Generations consume quota whether or not you like the result. Quota terms are on the pricing page.

6. Your Prompts

Your prompt text is sent to the AI provider exactly as you type it. It is sent without your identity attached — the provider receives the prompt and the generation parameters, never your name, email, or account ID.

Do not put personal information in a prompt — yours or anyone else's. Not names, not addresses, not phone numbers, not anything you would not want leaving our systems. Once a prompt reaches a provider it is retained under that provider's API terms, which we do not control.

7. The Commons — No One Owns Generated Content

This is the central bargain of the platform, and it is a contract, not a philosophy. As a condition of using the Service, every member agrees to all of the following, and every member gets the benefit of every other member's agreement:

• All content generated on this platform is free for any member to use. That includes every cat image, name, trait, and piece of lore — whether you generated it, someone else did, or the platform did.
• Free means free. Share it. Repost it. Print it. Sell prints of it. Remix it outside the platform. Build a fan site around it. Write your own stories about the cats. Put it on a shirt. You do not need our permission and you do not need the permission of the member who generated it.
• No exclusivity. No member has an exclusive right to any generated content. Many members may use the same cat for different things at the same time.
• No member may demand that another member stop using a cat. Not one you generated, not one you remixed, not one you merged. You waive any claim to make that demand, against us and against every other member.
• You cannot claim ownership of what you generate here. Generating a cat does not make it yours. You may say you made it — that is true, and the lineage records it — but “I made it” is not “I own it.”
• This is irrevocable. The freedom other members have in content you generated does not end when you stop using the Service, cancel a subscription, or delete your account.
• It runs to us as well. We may display, print, promote, and publish generated content — in the product, in marketing, and anywhere else — on the same terms as everyone else. We claim no exclusivity over it either.

What this section does not touch: the prompts you write are yours, and the platform itself — the Generative Cats name, design, code, and branding — is the intellectual property of Confirm Concept LLC and is not part of the commons.

Supporting context, not the basis of this section: in the United States, purely AI-generated output is generally held not to be copyrightable in the first place. We do not rely on that. The agreement above stands on its own regardless of how that doctrine develops.

8. Creations Are Permanent

The cosmos accumulates. Cats, planets, stars, portals, and the lineage links between them are permanent by design — a merge two years from now can reach back to a cat made today, and that only works if nothing disappears. There is no delete button for a creation, for you or for anyone else.

The one exception: we remove content when the law requires it. Specifically:

• a rights-holder demands removal and we choose not to contest the demand;
• the content is illegal;
• a court orders it.

9. Acceptable Use

Short list, plainly meant. You agree not to:

• Generate illegal content, or content that is sexually explicit, violent, depicts abuse, is hateful or discriminatory, or promotes harm against people or groups. Prompts pass through provider safety filters; do not try to get around them.
• Put another person's personal information in a prompt — names, likenesses, addresses, contact details, or anything else that identifies someone who did not ask to be here.
• Try to deanonymize members. Do not attempt to link a star, planet, cat, or account to a real person, and do not publish such a link if you believe you have found one. Anonymity is the platform's safety property, not a decoration.
• Run automated abuse. No bots, scripts, or scrapers against the Service; no circumventing rate limits, quotas, capacity controls, or security measures; no using the Service to build training data for a competing model; no reverse-engineering the platform or the models behind it.
• Infringe others' rights, or impersonate another member or the platform itself.

The platform has no comments and no direct messages, which removes most of the surface where harassment usually lives. What is left — reactions, remixes, and merges — are creative acts. Treat them that way.

10. Subscriptions and Payments

All payments are processed by Polar.sh, which acts as the Merchant of Record. Polar handles payment processing, tax compliance (VAT, GST, sales tax), invoicing, and refunds, and holds your payment details — we never see them. By subscribing you also agree to Polar's Terms of Service. Current prices and quotas are on the pricing page.

Payment buys generations and utility. It does not buy standing. Prestige on this platform comes from what the community does with your creations, and there is no way to purchase it.

11. Free Access and Capacity

Free accounts receive a limited number of lifetime creations at no cost, with no credit card. Because every generation costs us real money at an AI provider, free access is funded by paying subscribers and is therefore capped. When the free capacity for a period is taken, new free signups join a waitlist and we email them when a spot opens. Subscribers are never waitlisted.

12. Cancellation

Cancel any time through Polar's billing portal. You keep paid features through the end of the current billing period, then revert to the free tier. Cancelling is not deleting: your account, your star, and everything you have made stay exactly where they are.

13. Leaving Is Final

You can ask us to delete your account at any time. Read this before you do:

Deleting your account is permanent: your creations remain in the cosmos forever, unattributed, and if you return you begin as a new star.

Deletion removes your sign-in identity and every piece of personal data attached to your account. It does not remove your cats, your planets, your star, or the lineage they sit in — those are permanent under section 8 and free to every member under section 7. What disappears is the thread connecting them to you, and it disappears so completely that even we cannot reconnect it. There is no undo, no restore, and no way to reclaim a star you left. 14. Content Complaints

We do not operate a registered DMCA agent and we publish no formal takedown form. Instead, write to complaints@generativecats.app and a person will read it. We handle complaints case by case under the legal-compliance carve-out in section 8. See Content Complaints for what to include.

15. Suspension and Termination

We may suspend or terminate access for violation of these terms. When that happens, access to the Service ends; the content already made remains in the cosmos on the same terms as everyone else's, and the commons rights other members hold in it are unaffected.

16. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that AI-generated content will meet your requirements.

17. Limitation of Liability

To the maximum extent permitted by law, Confirm Concept LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

18. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Oregon.

19. Changes to These Terms

We may update these terms. The “Last updated” date at the top of this page changes when we do, and continued use after a change constitutes acceptance. Section 7 works only if it applies uniformly, so changes to it apply to all content on the platform, including content generated before the change.
